Settlement service

As of January 1, 2017, electricity and gas end users and prosumers can attempt to resolve a dispute that has arisen with their operator using conciliation, which becomes a necessary step before going to court.

TheSettlement Service has been established by the Authority to make a quick and easy procedure for resolving any disputes with operators available to electricity and gas end users, through the intervention of a conciliator specifically trained in mediation and energy who helps the parties reach an agreement. The Settlement Service is also available to prosumers (producers and consumers of electricity) for any disputes with operators and the GSE.

All operators, sellers or distributors, except FUI (Fornitura di Ultima Istanza i.e., Gas Supplier of Last Instance ), are required to take part in the conciliation attempt at the Authority's Service. The GSE is required to take part in the procedures activated by the prosumer if pertaining to on-site exchange or dedicated withdrawal.

Before the Settlement Service, it is possible to make a compulsory attempt at conciliation as a procedural condition for the access to ordinary justice.

Any agreement reached at the Settlement Service constitutes an enforceable title, i.e., it can be enforced by the parties before the competent court in the event of non-compliance with its contents.

The Settlement Service, operated by Single Buyer on behalf of the Authority, is free of charge and is conducted online, in accordance with European energy and Alternative Dispute Resolution (ADR) legislation. The Settlement Service is included in the ADR and European ODR lists regarding client issues.
